Terms & Conditions
These Terms and Conditions govern all contracts entered into by B&D Builders Ltd for the supply and sale of goods and services. Any order placed with the company shall be deemed to constitute acceptance of and agreement to be bound by these Terms and Conditions. No variation of these Terms and Conditions shall be valid unless agreed in writing by the company.
Description of Goods
The company website, brochures, drawings, visuals, and any illustrations are provided for guidance purposes only and do not form part of any contract. B&D Builders Ltd reserves the right to amend or alter specifications where necessary without prior notice. Some material sizes may be nominal and subject to normal industry tolerances.
Prices
All prices are subject to VAT at the prevailing rate unless otherwise stated. Once an order has been placed and the initial payment received, a written sales confirmation will be issued and the agreed price shall remain fixed.
Payments
Payments are due in the following stages:
50% payment is required once the base/foundation has been completed and part materials have been delivered to site.
40% payment is due upon completion of the first fix stage, including plasterboard installation and internal finish to that stage.
Final 10% payment is due upon full completion of the project, once the client has inspected the works and confirmed satisfaction that the project has been completed in accordance with the agreed specification.
The final payment must be made following client sign-off confirming acceptance of the completed works.
Cancellations
The client has the right to cancel their order within 14 days of the initial payment being made and receive a full refund. After this period, no refunds will be issued.
B&D Builders Ltd reserves the right to cancel any order prior to commencement or installation for any reason. In such circumstances, all monies paid by the client will be refunded in full.
Delivery and Installation Dates
The company will endeavour to meet estimated delivery and installation dates; however, these dates are not guaranteed. B&D Builders Ltd shall not be held responsible for delays caused by circumstances beyond its control, including but not limited to adverse weather conditions, access restrictions, parking limitations, supplier delays, or traffic issues. No compensation shall be payable for such delays.
Access to the installation site must be clear and suitable. The company will not transport materials through domestic buildings, over fences, or other obstacles unless agreed in advance in writing. Any parking permits or permissions required must be arranged by the client.
Bases and Installation Requirements
All sites must be level, structurally sound, and have adequate drainage in place. A minimum clearance of 400mm around the external dimensions of the building is required to allow safe construction.
The client must be present to confirm the positioning of the base prior to construction. Once the position has been confirmed and works commenced, it cannot be altered. Access to electricity and water must be available on site.
Whilst all reasonable care is taken to avoid damage to lawns, plants, trees, and landscaping, B&D Builders Ltd cannot be held responsible for any damage caused during installation.
Any apertures or service penetrations not supplied by B&D Builders Ltd will only be carried out if agreed in advance and detailed in the sales order.
Planning Permission
Planning permission is not normally required; however, it remains the sole responsibility of the client to confirm whether planning consent is required for the installation. Clients are advised to consult their local planning authority prior to commencement. However, at the same time, we can assist you with this matter.
Guarantee
All buildings supplied and installed by B&D Builders Ltd are covered by the following guarantees, which become valid once the final balance has been paid in full:
15-year guarantee on the main structural components against manufacturing defects, rot, and structural failure.
4-year guarantee on all electrical installations carried out by B&D Builders Ltd, subject to normal use and maintenance.
4-year guarantee on all other components, fixtures, finishes, and installations unless otherwise stated.
The guarantee excludes normal wear and tear, cosmetic finishes, and decorated surfaces.
Buildings constructed under “Permitted Development” regulations must not be used as habitable accommodation. Use for residential living purposes will invalidate all guarantees.
The guarantee assumes that the building is adequately heated, ventilated, and maintained in reasonable condition at all times.
Guarantee Claims
All requests for remedial or warranty work must be submitted directly to B&D Builders Ltd. Once approved, a maintenance team will attend to rectify the issue at no charge. The company will not reimburse costs incurred through third-party contractors unless prior written agreement has been given.
All guarantees are non-transferable.
Maintenance Responsibilities
It is the client’s responsibility to ensure that the area surrounding the building is kept clear and free from obstructions. Adequate airflow beneath and around the structure must be maintained to prevent moisture build-up.
Roofs, gutters, and drainage systems must be inspected and cleared of debris at least twice per year. Failure to carry out routine maintenance may result in damage to the structure and invalidate the guarantee.
Health and Safety
All installation personnel employed by B&D Builders Ltd are trained in Health and Safety procedures and use appropriate Personal Protective Equipment (PPE). Where a full Risk Assessment and/or Method Statement is required by the client, a minimum of 5 weeks’ notice must be provided. Additional charges may apply depending on compliance requirements.
Liability Insurance
B&D Builders Ltd holds public and employer’s liability insurance cover up to £5 million. Insurance details are available upon request.
Governing Law
This contract shall be governed by and construed in accordance with English law, and any disputes arising out of or in connection with this contract shall be subject to the exclusive jurisdiction of the English courts.
